PROBLEM/ISSUE STATEMENT

W.O. 19-22 is a project to install new street lighting along King Avenue East between Orchard Lane and Jackson Street.  If streetlights are installed, a Special Improvement Light Maintenance District (SILMD) is required to provide energy and maintenance to the new lights.  Council passed a Resolution of Intention to Create SILMD 326 at its February 24, 2020, meeting and set a March 23, 2020 public hearing on the proposed district.   Legal notice of the proposed district and public hearing was published and was mailed to all property owners in the proposed district in accordance with State law.

The new lighting will use cobra style poles with LED lamps and underground wiring. The SILMD will include the power costs for the district, anticipated annual maintenance costs for the lights, and the ability to replace the infrastructure when the equipment has exceeded its useful life.

The deadline for written protests is Monday, March 16, 2020 at 5:00 p.m.  The number and percentage of valid written protests received will be reported at the March 23, 2020 Council meeting.  As provided in State law, the City Council has the authority to create the district if the legal protest does not exceed 50%.

ALTERNATIVES ANALYZED

City Council may:
  • Pass the Resolution creating SILMD 326 to provide a source of funding for operation, maintenance and replacement of the streetlights; or
  • Do not pass the Resolution creating the district.  If the Council does not adopt the Resolution, the property owners cannot be assessed for operation, maintenance and replacement of the streetlights and the new lighting will not be installed.

FINANCIAL IMPACT

All costs of maintaining, replacing and providing energy for the lighting are paid from assessments against the properties within the light district.  There are no City owned properties within the district.

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and approve the resolution creating SILMD 326 if the valid protest does not exceed 50%.
