PROBLEM/ISSUE STATEMENT
At the March 23, 2020, meeting, council voted to approve the 2020 Missing Sidewalk/Miscellaneous program with the exception of the properties on Aronson Avenue from Nutter Boulevard to Governors Boulevard. At the April 13, 2020, meeting, council voted to bring the 2020 Missing Sidewalk/Miscellaneous program resolution back for discussion. At the May 11, 2020 meeting, council voted to add the resolution to the May 26, 2020 agenda. Council will have the ability to vote to keep the Resolution as originally proposed; to keep it as approved, all sidewalks included with the exception of those on Aronson Avenue; reject the Resolution completely; or any other action desired by council.
The Missing Sidewalk/Miscellaneous project is intended to concentrate on installing sidewalk in areas that are missing pedestrian facilities. As a priority, City staff identified areas that are along arterial streets, collector streets, school routes, or in high pedestrian areas for inclusion in this program. The streets identified as needing sidewalk are Aronson Avenue from Governors Boulevard to Nutter Boulevard; 11th Avenue North from North 22nd Street to North 27th Street, and ADA improvements to the sidewalk on the west side of 24th Street West between Lewis Avenue and Broadwater Avenue. Along with the missing sidewalk, there is miscellaneous concrete work to address problems throughout the city, including ADA improvements, that are too large for the sidewalk tripper repair or replacement projects.
The property owners are responsible for paying for sidewalk on their addressed side and drive approaches on both addressed and non-addressed sides. The City is responsible to pay for curb and gutter replacement, sidewalk on non-addressed sides of properties, and ADA improvements at corners and on sidewalks that are in good condition, but were constructed before ADA requirements were in place. The City also pays for any additional width of sidewalk installed on the addressed side over five feet wide. There are a number of properties within the district that have an assessment of zero. The improvements along their property is either on the non-addressed side or curb, gutter, or ADA improvements only. Identifying the properties in the Resolution allows those property owners to add improvements to the project and be assessed for them which is a common occurrence for this project.

ALTERNATIVES ANALYZED
The Council may:
- Approve the Resolution ordering construction of the improvements; or
- Approve the Resolution ordering construction of the improvements with modifications; or
- Do not approve the Resolution ordering construction of the improvements. If the Council does not approve the Resolution, the property owners cannot be assessed and the work will not occur because there is no other source of funding.
FINANCIAL IMPACT
The project is funded through gas tax and direct property assessments. The assessments included in the resolution are in the amount of $390,000.
RECOMMENDATION
Staff recommends that Council approve the Resolution Ordering Improvements for the 2020 Missing Sidewalk/Miscellaneous Program.
