RECOMMENDATION

Staff recommends the City Council reject all bids for WO 20-02 Missing Sidewalk/Miscellaneous.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The Missing Sidewalk/Miscellaneous project is intended to concentrate on installing sidewalk in areas that are missing pedestrian facilities.  As a priority, City staff identified areas that are along arterial streets, collector streets, school routes, or in high pedestrian areas for inclusion in this program.  The streets identified as needing sidewalk are Aronson Avenue from Governors Boulevard to Nutter Boulevard; 11th Avenue North from North 22nd Street to North 27th Street, and ADA improvements to the sidewalk on the west side of 24th Street West between Lewis Avenue and Broadwater Avenue.  Along with the missing sidewalk, there is miscellaneous concrete work to address problems throughout the city, including ADA improvements, that are too large for the sidewalk tripper repair or replacement projects. 

The 2020 Missing Sidewalk/Miscellaneous program was created at the May 26, 2020 City Council meeting.  

The project was advertised on June 5, June 12, and June 19, 2020, in the Yellowstone County News and on the City's website.  Bids were opened on June 23, 2020 and two bids were received.  FirstMark Construction LLC submitted the lowest, responsible bid.  The bids were significantly higher than the estimate in the resolution so staff is recommending that bids be rejected.  Staff thinks bidding the project in a more favorable bid environment will result in lower bids.  In this case, a more favorable bid environment is one where contractors are not too busy to do the work.  Staff intends to bid the project in winter/spring 2021.

ALTERNATIVES

City Council may:
  • Reject all bids.  This will allow Engineering to re-evaluate the project and possibly splitting the project and bidding at a more favorable time.  There is not an alternative to rejecting bids as the assessments create a bond amount higher than approved in the resolution.

The project was budgeted in FY20 using Gas Tax and Assessments.  The amount budgeted was $711,000.  The bid was higher because of an unfavorable bidding environment.
