RECOMMENDATION
Staff recommends City Council approve the Resolution of Intent to Create the SILMD to supply electricity to the State of Montana owned lights on 27th Street and set a public hearing date of October 12, 2020.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The State of Montana is currently in the process of improving North & South 27th Street from the I-90 Interchange to Rimrock Road. The project includes the installation of 158 street lights within the project area. The State of Montana will own and maintain all 158 lights while Northwestern Energy will provide electricity to 126 of the lights located between the north right-of-way of State Avenue and south right-of-way of Rimrock Road. The City will administer the SILMD by assessing the property owners for the costs of the district and paying Northwestern Energy for the electricity. Passage of this Resolution of Intent is the first step in the legal process of creating a lighting maintenance district to pay the operation costs. Passage of this Resolution of Intent will trigger the mailing of legal notices to the affected property owners and set a public hearing at the October 12, 2020, City Council meeting.
The new lighting will use LED lamps and underground wiring. The cost of installation and ongoing maintenance for the new lighting will be paid for by the State of Montana. The adjacent property owners will only pay for electrical energy through an assessment on their property tax statements. Light district assessments are $0.58 per lineal foot and will range from approximately $0.58 to $1,157.78 per year depending on the 27th Street frontage of the property within the District boundary.

ALTERNATIVES
City Council may:
- Pass the Resolution of Intent to Create SILMD 328 to provide a source of funding for operation of the streetlights and set a public hearing for October 12, 2020; or
- Do not pass the Resolution of Intent or set a public hearing date. If the Council does not adopt the Resolution, the property owners cannot be assessed for operation of the streetlights, so the new lighting will be installed, but it will not be turned on.
FISCAL EFFECTS
There are eleven City of Billings owned properties located within the District. The total assessed frontage is 1,546 feet, equaling an estimated total annual assessment of $897.21.
