RECOMMENDATION

Staff recommends approval of the amended SIA, Section III Transportation B. Sidewalks, for the Ironwood Estates Subdivision, 5th Filing, to the City Council.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

On October 15, 2020, Wells Built Inc., Steve Wells, applied for an amendment to the SIA for Ironwood Estates Subdivision, 5th Filing.  Wells Built is requesting to amend the required location of sidewalks for Lots 62 and 63 within the subdivision to make a better connection to future sidewalks and the trail system in the subdivision. They are requesting to change the paragraph under the heading III Transportation B. Sidewalks (See attached Proposed Amendment to the SIA).

Ironwood Estates Subdivision, 5th Filing, was recorded on August 24, 2012.  At that time the SIA, under the heading Transportation B. Sidewalks, states; Standard five-foot wide boulevard style sidewalks are required and will be installed by the lot owner at the time of lot development along the streets in this filing.  Pedestrian/bike paths shall be constructed in various linear park areas throughout the subdivision and shall follow the City of Billings design standards.  In areas where City utility maintenance vehicles are anticipated, the trail shall be a minimum of 10-feet wide.  
 
Ironwood Estates Subdivision, 5th Filing is surrounded by previous filings of Ironwood where requirements for sidewalks and trails differ. They would like to change the language in the SIA so Lots 62 and 63 of Ironwood Estates Subdivision, 5th Filing would not be required to install sidewalks along the frontage.  There is no sidewalk to the north of lots 62 and 63 along Aspenridge Drive.  The remaining lots in Ironwood Estates Subdivision, 5th Filing would be required to install sidewalks along the frontages.
 
Wells Built is requesting to relocate a crosswalk on the southern side of lot 62  farther west so it will connect with future trails and sidewalks as the subdivision develops. City staff has reviewed the requested change to the SIA and found it is a good solution. This will provide a continuous connected walking surface through the subdivision when it is built out. See Attachment A.

ALTERNATIVES

The City Council May:
  • Approve the amendment to the SIA, Section III Transportation B. Sidewalks, for the Ironwood Estates Subdivision, 5th Filing, or
  • Not approve the amendment to the SIA, Section III Transportation B. Sidewalks, for the Ironwood Estates Subdivision, 5th Filing. If the amendment is not approved, a dead end sidewalk and lack of a continuous connection for walking through the neighborhood will remain in this area of the City.

FISCAL EFFECTS

The proposed amendment to the SIA will have no financial impact on the Planning Division.
