RECOMMENDATION
Staff recommends the City Council accept the perpetual right-of-way easement between the City of Billings and Yellowstone County which includes a new sanitary sewer lift station and relocated sanitary sewer pipelines within the MetraPark property. Land area requested for the necessary additional permanent easement area is equal to 1.17 acres. Recommended compensation to Yellowstone County is $17,000 and is based on the September 3, 2020 restricted-use appraisal of the property conducted by Thomas Appraisal Services.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The City of Billings is currently completing designs for a new sanitary sewer lift station (W.O. 19-21) and for new 60-inch and 48-inch sanitary sewer influent pipelines (W.O. 20-01) which are located on MetraPark property owned by Yellowstone County. The new lift station site requires an additional 1.17 acres of land area, and the new influent pipelines will replace existing pipelines in a new alignment.
The existing pipelines, Water Reclamation Facility (WRF) and WRF access road are included in an existing Perpetual Right-of-Way Easement between the City and County dated August 28, 2017. This existing document will remain in effect; however, the easement corridors covering the existing pipelines will be vacated under the new easement.
Compensation of $17,000 for the new permanent easement area has been agreed to by the County and was estimated in the Restricted-Use Appraisal conducted by Thomas Appraisal Services.

ALTERNATIVES
City Council may:
- Approve the new perpetual right-of-way easement between the City and Yellowstone County and agree to compensation for the permanent easement in the amount of $17,000, or;
- Disapprove the easement. If easement is not approved, the City will not be able to legally construct the lift station and relocate the sanitary sewer pipelines. Both projects are needed for successful long-term service to City sewer customers.
FISCAL EFFECTS
The $17,000 compensation to Yellowstone County for the additional permanent easement area was budgeted in FY20 under W.O. 19-21, WRF Influent Lift Station project using wastewater funds.
