RECOMMENDATION

Staff recommends City Council approve the Resolution of Intent to create Street Improvement Light Maintenance District (SILMD) 330 and amend SILMD 280 and set a public hearing date of March 08, 2021.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

Reconstruction of S. 32nd Street West between King Avenue West and Transtech Way is planned in 2021. The planned improvements include the installation of 25 streetlights within the project area. The City will administer the SILMD by assessing the property owners for the costs of maintaining the district and paying Northwestern Energy for the electricity.  Passage of this Resolution of Intent is the first step in the legal process of creating a lighting maintenance district to pay the maintenance and operation costs. Passage of this Resolution of Intent will trigger the mailing of legal notices to the affected property owners and set a public hearing at the March 8, 2021, City Council meeting.

The new lighting will use LED lamps and underground wiring.  The cost of installation will be paid for with project funds.  The adjacent property owners will only pay for electrical energy, ongoing maintenance, and administration costs through an assessment on their property tax statements.  Light district assessments are estimated at $0.891456 per lineal foot and will range from approximately $6.12 to $1,151.24 per year depending on the S. 32nd Street West frontage of the property within the District boundary. The total yearly assessment is estimated to be $7,500.

There is 1 light on the west side of S. 32nd St West near King Avenue West that will be removed from SILMD 305 and added to the new SILMD 330. There are also 10 streetlights from SILMD 280 located on S. 32nd Street West between Transtech Way and Conrad Road that will be removed from SILMD 280 added to the new SILMD 330.  These lights currently have HPS luminaires, the project plans to retrofit these lights with LED luminaires to match the new lights being installed. 

SILMD 280 will be amended to remove lots on the west side of S. 32nd St West as they will no longer benefit from SILMD 280 once the existing streetlights are converted to SILMD 330. SILMD 305 will not be amended as there will be no lots removed and the removal of one light from the district will make less than a 3% impact on assessments within SILMD 305. Corner lots currently under assessment in existing light districts will also be assessed in the new SILMD 330 as they benefit from lighting in both districts.
 

ALTERNATIVES

City Council may:
  • Pass the Resolution of Intent to Create SILMD 330 to provide a source of funding for operation and maintenance of the streetlights and amend SILMD 280 and set a public hearing for March 08, 2021; or
  • Do not pass the Resolution of Intent or set a public hearing date. If the Council does not adopt the Resolution, the property owners cannot be assessed for operation and maintenance of the streetlights, so the new lighting will not be installed.

FISCAL EFFECTS

There is no financial impact to the City as there are not any City of Billings owned properties located within the SILMD.
