Staff recommends the City Council hold a public hearing and approve this ordinance on first reading, adding recently annexed property to Ward I.

Aviation Properties LLC submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located north of Highway 3 and both East and West of AJ Way.The property is described as Tracts 1A and 1B, of Certificate of Survey No. 1889 Amended, recorded December 28, 2010, under Document No. 3574908, on file and of record in the Records of Yellowstone County; and Portions of Tracts 13 and 14, of Certificate of Survey No. 2037, recorded December 23, 1980, under Document No. 1185840.

The property contains 49.34 gross and 45.972 net acres.

Upon Council approval, this annexation requires a change in the boundaries of Ward I. Two readings are required for this action. The first reading of the ordinance is tonight at this Council meeting, along with a public hearing, and the second reading is scheduled for March 8, 2021.

City Council may:

• Approve adding the subject property to Ward I, or;
• Disapprove adding the subject property to Ward I.

Disapproval will not modify the boundary of Ward I and will create a problem where property inside the City Limits is not within a City Ward.
