Title: Public Hearing and Resolution Creating SILMD 330 and Amending SILMD 280

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and approve the resolution creating SILMD 330 and amending SILMD 280 if the valid protest does not exceed 50%.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

Reconstruction of S. 32nd Street West between King Avenue West and Transtech Way is planned for 2021. The planned improvements include the installation of 26 LED streetlights and underground wiring within the project area. An additional 11 lights will be removed from their existing districts, retrofitted with LED luminaires and added to SILMD 330. The City will administer the SILMD by assessing the property owners for the costs of maintaining the district and paying Northwestern Energy for the electricity.   Council passed a Resolution of Intent to Create SILMD 330 and amend SILMD 280 at its February 08, 2021, meeting and set a March 08, 2021 public hearing on the proposed district. Legal notice of the proposed district and the public hearing was published and mailed to all property owners in the proposed district in accordance with State law.

If the Resolution to create SILMD 330 and amend SILMD 280 is approved, the 11 SILMD 280 lights shown on Exhibit A will be moved to SILMD 330, and the 5 lots described in Exhibit B of the attached Resolution will be removed from SILMD 280 and included in SILMD 330.

The deadline for written protests is Friday, March 05, 2021 at 5:00 p.m.  The number and percentage of valid written protests received will be reported to City Council at the March 08, 2021 Council meeting.  As provided in State law, the City Council has the authority to create the district if the legal protest does not exceed 50%.

ALTERNATIVES

City Council may:
  • Approve the Resolution creating SILMD 330 and amending SILMD 280 to provide a source of funding for the operation, maintenance, and replacement of the streetlights; or
  • Disapprove the Resolution creating the district.  If the Council does not adopt the Resolution, the property owners cannot be assessed for the operation, maintenance, and replacement of the streetlights and the new lighting will not be installed.

FISCAL EFFECTS

There is no financial impact to the City as there are not any City of Billings owned properties located within the SILMD.
