RECOMMENDATION
Staff recommends the City Council hold a public hearing and approve this ordinance on first reading, adding recently annexed property to Ward III.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Crown Enterprises, Inc. submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located south of the South Frontage Road, East of East Lane and North of Elysian Road and West of Hogan's Slough. The property is legally described as Lot 5A, of Amended Plat of Lots 2, 3, 4, and 5 of, QFC Subdivision, First Filing, recorded September 09, 2020, under Document No. 3937860, on file and of record in the Records of Yellowstone County. Including all adjacent rights-of-way of South Frontage Road, Interstate 90, Hogans Slough and Bike Path Right-Of-Way as shown and dedicated within QFC Subdivision, First Filing, recorded May 15, 2019, under Document No. 3882956, on file and of record in the Records of Yellowstone County. The annexation contains 19.240 gross and 16.000 net acres.
Upon Council approval, this annexation requires a change in the boundaries of Ward III. Two readings are required for this action. The first reading of the ordinance is tonight at this Council meeting, along with a public hearing, and the second reading is scheduled for April 12, 2021.

ALTERNATIVES
City Council may:
- Approve adding the subject property to Ward III, or;
- Disapprove adding the subject property to Ward III.
Disapproval will not modify the boundary of Ward III and will create a problem where property inside the City Limits is not within a City Ward.

This item has no impact on the Planning Division Budget.
