RECOMMENDATION
Staff recommends the City Council hold a public hearing and approve this ordinance on first reading, adding recently annexed property to Ward I.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Lupine Holdings LLC submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located north of Highway 3 and West of AJ Way. The property is described as Tracts of Land situated in the NE 1/4 and the SE 1/4 of Section 26, T.1N., R.25E, P.M.M., Yellowstone County, Montana, more particularly described as follows: Tracts 1A and 1B, of Certificate of Survey No. 1889 Amended, recorded December 28, 2010, under Document No. 3574908, on file and of record in the Records of Yellowstone County; Including all adjacent rights-of-way of Montana State Highway No. 3. The property contains 21.852 gross and 20.016 net acres.
Upon Council approval, this annexation requires a change in the boundaries of Ward I. Two readings are required for this action. The first reading of the ordinance is tonight at this Council meeting, along with a public hearing, and the second reading is scheduled for May 24, 2021. This process typically runs concurrent when annexations are considered, however, given the conditions of approval related to AN20-05B this process needed to be delayed.
