Contract with Land Design, Inc. for Creation of Byron Nelson Park Master Plan

PROBLEM/ISSUE STATEMENT

In April 2010, the Yellowstone Country Club Estates (YCCE) Homes Association contacted Parks, Recreation and Public Lands (PRPL) to discuss the possibility of developing Byron Nelson Park.  Byron Nelson Park is a vacant 4 acre tract located on the northwest corner of 54th Street West and Bobby Jones Boulevard.  Since Byron Nelson Park does not have an approved master plan, the Homes Association agreed to provide funding for the plan preparation.  A Request for Proposals was issued and Land Design, Inc. of Billings was selected.  See the attached Contract For Services.  If the contract is approved, work on the master plan will commence immediately.  The intent of the Homes Association is to develop the master plan and then solicit support from property owners to approve a Special Improvement District (SID) and a Parks Maintenance District (PMD) to build and maintain the park.  YCCE does not have waivers of protest in place, so a majority of the property owners in the benefit district will need to approve the creation of the SID and PMD to fund the construction and maintenance of Byron Nelson Park.  The Parks, Recreation and Cemetery Board favors the development of Byron Nelson Park.    

ALTERNATIVES ANALYZED

The Council may:

  1. Approve the contract to develop a master plan for Byron Nelson Park.
  2. Do not approve the contract.

FINANCIAL IMPACT

There will be no financial impact to the City of Billings.  The Yellowstone Country Club Homes Association will fund the cost of the master plan.  An SID and PMD will fund the construction and maintenance costs of the park if approved by the property owners of the benefit district and the City Council.

RECOMMENDATION

Staff recommends Council approve the contract to create a park master plan for Byron Nelson Park.
