RECOMMENDATION
Staff recommends the City Council accept the quit claim deed for Tract 7, COS 550 from Kurt Haeker.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Tract 7 of COS 550 recorded under Document No. 500842 is a 10-foot wide strip of land created in 1952, currently owned by Mr. Haeker. This strip of land has functioned as an alley for over 50 years and has therefore created a prescriptive easement for public use. The tract is located between 15th Street West and 16th Street West, north of Burlington Avenue. The tract area is about 0.12 acres. This parcel is unbuildable in the current state. Accepting the deed will clean up property ownership along this alley, allowing a consistent, City-owned alley.
ALTERNATIVES
City Council may:
- Approve and accept the quit claim deed or,
- Not approve and not accept the quit claim deed.
FISCAL EFFECTS
Tract 7 of COS 550 is being deeded to the City by Mr. Haeker at no cost to the City.
