PROBLEM/ISSUE STATEMENT

The final plat for Lenhardt Square Subdivision, 2nd Filing, is being presented to Council for approval. On December 10, 2009, City staff held a pre-application meeting with the applicant to discuss the creation of a two-lot subdivision of 20.73 acres of land. It was determined at that time that the subdivision qualifies for the expedited plat review process, which allows, under certain conditions, subdivisions creating just two lots to proceed straight to final plat review. The subject property is located on the northwest corner of King Avenue West and 44th Street West. It is zoned Planned Development – Lenhardt Square. There is one existing single-family residence (the original homestead before development started) on proposed Lot 1, and Lot 2 will continue to be used for agriculture until it is further divided and/or developed. The property owner, Lenhardt Property, LP, submitted this expedited plat in order to maintain the existing residence on a smaller land parcel, which reduces the tax burden for the entire property.  The agent for this application is Sanderson Stewart. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Lenhardt Square Subdivision, 2nd Filing. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA, 76-3-611 and BMCC, Section 23-305(F).

FINANCIAL IMPACT

Should the City Council approve the final plat, the creation of a one-acre lot for the existing residence and a 19-acre agricultural lot will result in decreased revenues for the City due to the reduction in special assessments such as storm sewer, street maintenance and the arterial construction fee. 

RECOMMENDATION

Staff recommends that the City Council approve the final plat of Lenhardt Square Subdivision, 2nd Filing.
