PROBLEM/ISSUE STATEMENT
Access to the Briarwood Reservoir crosses undeveloped private land. The existing agreements for access have expired. The purpose of this agreement is to provide the City with access across the property owned by PM and M, LLC, Max E. Thorton and the Katherine K Thorton Testamentary Trust. The access license is for five years with the option for three year renewals following this period. When this property is developed, a permanent easement will be sought once a site plan is drafted.
ALTERNATIVES ANALYZED
The City Council may approve or disapprove the agreement. If disapproved, the City would not have access to the water reservoir and maintenance and repair would not be possible.
FINANCIAL IMPACT
Approving the license agreement does not have an immediate financial impact on the City.
RECOMMENDATION
Staff recommends that Council approve the license agreement for access across private land to the Briarwood Water Reservoir.
