RECOMMENDATION
Staff recommends the City Council approve the final expedited plat and SIA of Big Sky King Subdivision.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
On October 27, 2021, Performance Engineering applied for final expedited minor plat approval for Big Sky King Subdivision. An expedited subdivision is a subdivision that:
1. Meets the definition of a first minor subdivision from a tract of record; and
2. Legal and physical access to all lots is provided; and
3. No land in the subdivision will be dedicated to public use for parks or playgrounds; and
4. The plat has been approved by the Montanan Department of Environmental Quality or County Environmental Health whenever approval is required or the plat has been approved by the City of Billings Public Works Department for sanitary water, sewer and storm water facilities; and
5. No public improvements are needed.
This subdivision meets all those criteria. It is a lot of record, Certificate of Survey 1718 Amended, Parcel 1; all lots will have access off Grand Avenue; they are not required to dedicate parkland; they will connect to existing water and sewer lines in Grand Avenue and public improvements are not required by City Engineering at this time.
The proposed subdivision creates 2 lots for commercial development. Proposed Lot 1 has an existing business on it, proposed Lot 2 is vacant. The subject property is generally located at 1438 Grand Avenue. The current zoning is Corridor Mixed Use 2 (CMU2). Staff has reviewed the application and determined that the proposed plat has met all the requirements of development for the 2 lot minor and is forwarding a recommendation of final approval to the City Council. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES
The City Council may approve or disapprove the expedited plat of Big Sky King Subdivision. If the City Council chooses to deny the final expedited plat, the denial must be because the criteria in required by BMCC 23-305 have not been met. These criteria are provided in the Background section of this staff report. Staff finds the final plat meets the criteria outlined.
FISCAL EFFECTS
The final plat of this subdivision will have no financial impact on the Planning Division.
