RECOMMENDATION
Staff recommends that City Council approve the lighting facilities transfer agreement with the Billings Clinic and the resolution to amend the boundaries of Street Improvement Lighting Maintenance Districts (SILMDs) 13 & 14.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Billings Clinic requested to assume ownership of various streetlights that border its campus, so they could replace the existing lights with new poles and LED fixture heads which would match the lights on the rest of the Billings Clinic campus. This is beneficial to the City because these lights were old and in need of replacement. Also, the City will not have to maintain these lights going forward. Thus, City staff was in general agreement that transferring these lights to Billings Clinic was a mutual benefit to both Billings Clinic and the City. Billings Clinic proceeded to change out the lights prior to obtaining an agreement with the City and staff was later notified that the lights were already modified. There are thirty-three (33) used and dated electric lighting fixtures and facilities including luminaries mounted on steel poles, underground wiring and associated appurtenances and equipment that are affected.
A boundary adjustment is needed for SILMDs 13 and 14 because Billings Clinic is assuming ownership of these lights. Twenty-nine lights in SILMD 13 and 2 lights in SILMD 14 will no longer be paid for by the City and properties adjacent to the lights will be removed from the SILMDs. There are also 2 lights that were removed from SILMD 259, but a boundary adjustment is not required for this District.

ALTERNATIVES
City Council may:
- Approve the lighting transfer agreement and the resolution to amend the boundaries of SILMDs 13 & 14 ; or,
- Disapprove the lighting transfer agreement and the resolution to amend the boundaries. If the agreement and the boundary amendment are not approved, the City will need to continue paying for the electricity and maintenance of the 33 lights.
FISCAL EFFECTS
There is a very minimal financial effect on SILMDs 13 and 14 due to both lights and parcels being removed. The costs for SILMD 259 will decrease slightly because of the removal of 2 lights.
