RECOMMENDATION
Staff recommends the City Council award a contract for W.O. 20-41, Landfill Gas Collection System Lift One, to KLE Construction in the amount of $789,380.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
W.O. 20-41, Landfill Gas Collection System Lift One, is intended to construct horizontal gas collection piping in the areas of the landfill that are actively being filled (also known as the “open cells”), as well as a 16-inch pipe that will transfer landfill gas from the gas collection piping to the landfill gas compliance flare. The landfill gas compliance flare is currently in the process of being advertised for procurement under a separate work order. This project represents the first of three layers filled as part of ongoing landfill operations. Gas collection piping will be added in the subsequent layers of the landfill under separate work orders in the future, which will occur over a period of one to five years as waste is continually being added in this active portion of the landfill.
The intent of this project is to meet environmental regulatory requirements under the Title V air quality permit issued by the Montana Department of Environmental Quality (MDEQ). As organic wastes decompose over time, a natural byproduct is created known as Landfill Gas (LFG). LFG is composed largely of methane and carbon dioxide, as well as a small amount of non-methane organic compounds. During a recent gas monitoring project, it was discovered that the landfills open cells are operating outside the emissions limits established by the EPA and MDEQ.
The project was advertised on April 1, April 8, and April 15, 2022, in the Yellowstone County News and on the City’s website. Bids were opened on April 19th and four bids were received. KLE Construction submitted the lowest, responsible bid.

ALTERNATIVES
The Council may:
- Award W.O. 20-41, Landfill Gas Collection System Lift One, to KLE Construction in the amount of $789,380; or
- Not award a contract and reject all bids. If the project is not awarded, the landfill will continue to produce gas emissions that are in excess of the environmental regulation limits, and the City may be subject to fines.

The low bid is $789,380 and there is adequate budget in the FY22 Solid Waste Landfill Fund for this project. Over time, the cost of these improvements will be covered by income generated by the production and sale of natural gas.
