RECOMMENDATION
Staff recommends that City Council accept the stormwater and sanitary sewer easements from Canal Vista LLC.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Canal Vista is condominium development located in Lake Hills Subdivision north of Lake Hills Golf Course. As part of the development of Canal Vista, public sanitary sewer mains will be extended onto private property. This requires the acceptance of an easement for the public sanitary sewer mains, to allow Public Works to maintain the mains.
The storm drain system for the development has been approved by the City. The storm drain system will be maintained by the homeowner's association. However, if the homeowner's association ever stops maintaining the storm drain system, acceptance of an easement would allow the City to maintain the storm drain system. If this situation happened, the city would assess the property owners for the maintenance. The stormwater easement is consistent with how stormwater runoff is handled with subdivisions and condominium type developments where homeowner's associations are involved.

ALTERNATIVES
The City Council may:
- Approve the stormwater and sanitary sewer easements; or
- Not approve the easements. If not approved, the developer will be required to propose a different design for the sanitary sewer. The stormwater will be maintained by the homeowner's association. If the easement is not approved, there will be no backup for maintenance.
FISCAL EFFECTS
There is no cost to the City for acceptance of the easements.
