RECOMMENDATION
Staff recommends the City Council approve the Amended SIA for Shiloh Business Park Subdivision.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
On September 26, 2022, Costco Wholesale submitted documents to amend the existing SIA for Shiloh Business Park Subdivision. Specifically, they are requesting to remove 'Exhibit A' from the original SIA. Exhibit A was unintentionally included. The removal of Exhibit A (page 17 of the filed document) is not material to the originally recorded document. The conceptual private roads depicted were never requirements of the development through any development process or any city regulations. As Costco prepares to develop this site the depiction of the road within the filed document is creating challenges from a documentation standpoint. The best way to alleviate those challenges is by amending the document.
The submitted documents will remove 'Exhibit A' from the original SIA. The newly filed document will be in addition to the originally filed document, it will not replace it. The Whereas clauses address this. The documents submitted are based on the recommendations from City Legal Department and the County Clerk and Recorder.

ALTERNATIVES
The City Council may approve or disapprove the Amended SIA for Shiloh Business Park Subdivision. Disapproval of amending the SIA would only continue to create complications with the filed documents for the Shiloh Business Park Subdivision and lot owners.
FISCAL EFFECTS
The Amended SIA for Shiloh Business Park Subdivision have no financial impact on the Planning Division.
