RECOMMENDATION

Staff recommends that City Council accept the perpetual right-of-way easement from Bradley W Hardt and Tammy Jo Hardt.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The Hardt family owns Certificate of Survey 2715 and the unplatted property to the east.  These properties are located south of Central Avenue and approximately one-half mile west of Shiloh Road.  The City is proposing to install a sanitary sewer main from east to west along the southern boundary of the property.  This trunk sewer extension is part of the larger WO 23-07 Monad Sewer project that will provide gravity sewer service from Shiloh Road west to 48th Street West (along the north side of the Monad Drain) and south along 48th Street West to the intersection of King Avenue West/48th Street West.  The sewer project is currently in the design phase.  Constructing the sewer will allow the property to develop in the City and connect to the sanitary sewer.  Attached is a perpetual right-of-way easement to allow construction and maintenance of the sanitary sewer.  

ALTERNATIVES

The City Council may:
  • Approve the perpetual right-of-way easement; or
  • Not approve the easement. The City would not be able to construct the sanitary sewer in the planned location.  The easement is at the request of the City and the property owner.

FISCAL EFFECTS

There is no cost to the City for acceptance of the easement.
