RECOMMENDATION
Staff recommends that City Council approve and award a contract for independent, third-party Commissioning Services of New City Hall to McKinstry Essention, LLC for $110,000.00.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Systems Commissioning and functional testing is a requirement of section C408 of the International Energy Conservation Code, commonly referred to as IECC. This I-Code applies to commercial buildings and all associated equipment. A summation of the section is that new equipment must be more efficient than what is being removed.
On a macro level, Commissioning Services, and a Commissioning Agent, provide quality control. On a micro level, the role of a third-party Commissioning Agent is to plan, document, test/adjust/balance (TAB), and verify that building equipment has been installed correctly per manufacturers recommendations and function/operate as intended by the engineering basis of design. Specifically for this project the scope of work includes mechanical, electrical, plumbing, generator, lighting, and building automation systems (BAS).
As the owner’s technical representative, the benefits of Commissioning Agent are impartial review to ensure:
- Quality control
- Installed equipment meets the design intent
- Reduction of change orders and project delays
- Identify issues during construction, provide correction notices, and minimize issues upon start-up
- Proper functioning, interfacing, and sequencing
- Efficient operations and systems optimization
The Facilities Division advertised an RFP for third-party Commissioning Services on 03/17/2023 and 03/24/2023 in Yellowstone County News and on the City’s Website.
Six (6) proposals were submitted by 04/07/2023.
A selection committee reviewed the proposals and selected McKinstry based on the following categories:
- Cover Letter
- Relevant Experience with projects of similar magnitude
- References
- Proposed Staff
- Current Workload
- Sample Log
- Firm Details
McKinstry was found to have the most relevant experience in new construction Commissioning and retro-Commissioning.

FISCAL EFFECTS
The cost of the prime contract for Commissioning Services will be funded by the Stillwater Construction Account.
