RECOMMENDATION

Staff recommends the City Council reject all bids for WO 23-04, City ADA Project.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

W.O. 23-04, City ADA Project, is a project consisting of Americans with Disabilities Act (ADA) accessible ramp construction on street corners where the City will soon be completing pavement overlays and chip seals.  Additional ramps will be constructed on other corners at various locations throughout Billings.

The annual ramp construction project is in accordance with the City’s agreement with the Department of Justice (DOJ) to install and/or upgrade ramps along streets constructed or reconstructed after 1992 and in specific areas identified by need.  The miscellaneous ramp locations were selected based upon neighborhood requests.  The ADA project will be on State Avenue, Colton Boulevard, and 19th Street West near Rose Park Elementary School. The City has approximately 8,500 ramps, and it is estimated that 20% of the ramps have been constructed or reconstructed to the current design standard.

The project was advertised on April 14, April 21, and April 28, 2023, on the City's Website and in Yellowstone County News. Bids were opened on May 2, 2023, and two bids were received.  Both bids were higher than the estimate and project budget.  Staff reviewed the bids and will change the project and re-bid in the Fall 2023 in order to obtain improved pricing.

ALTERNATIVES

The Council may:
  • Reject all bids for Work Order 23-04.  There is no viable alternate.

FISCAL EFFECTS

The project was budgeted in the amount of $250,000 in FY23 using Gas Tax funds.  Staff is researching why the bid was higher than the estimate. One possible reason includes the current market of contractor workloads.  The project will be evaluated to determine how to proceed to get the work completed within the approved budget.
