Adopt Resolution 13-02, abandoning the alleyway within block 10 of the Bowie Townsite as described therein.
Background:
Richard and Joanna Hall the owners of APN 302-27-037 and -037A
requested an abandonment of the 20' wide alleyway. When the property APN 302-27-037A was purchased in 1972 the applicant had their home and other structures built. In 2001 the applicant was able to purchase APN 302-27-037 for their livestock. Now the applicant wishes to combine both parcels to make one large parcel. Approval of the abandonment request would eliminate the applicants concern regarding the placement of the buildings. Please see attached application.
A review of the criteria for the abandonment was conducted as follows:
• The alleyway is not on a section or mid-section line and does not provide sole legal access to any current parcel.
• The Transportation Planner had no objections to the abandonment and her comments are attached.
• Two local utilities, SW Gas Corporation and Sulphur Springs Valley Electric Co-Op were contacted and no objections were received.
• Compensation for the proposed abandoned alleyway was determined to be $200 based on the land values in Bowie. That amount has been received.
In as much there are no objections, the alleyway is unnecessary for public road use, this department recommends full abandonment.

Department's Next Steps (if approved):
If abandoned, and once abandonment documents have been executed, no further Board action is required.
Impact of NOT Approving/Alternatives:
If abandonment is not approved, the unused alleyway will remain a public right-of-way.
