Agenda Item Text:
Adopt Resolution 16-02 authorizing the acceptance of a donation of property in San Simon proposed by the San Simon Gin Company.
Background:
Cochise County Highway and Floodplain department was contact by Bud Ratliff and Truman Thomas owners of APN 303-05-001D, wanting to donate a portion, approximately 3.2 acres, of a parcel to Cochise County. The subject parcel is located in the San Simon area of Cochise County. The department is interested in the donation and will use the property for material and equipment storage. Currently the department lacks a secure facility in this area. Two buildings were originally on the property. The cotton gin facility has been removed; however a small office building remains, is part of the donation and has future potential use. A title report was issued from Pioneer Title with no issues noted. The parcel was surveyed, legal descriptions were created, a utility easement was formed (and recorded) for San Simon Water District. As requested by the property owners, an Agreement for Transfer of Property was created and the owners have signed the agreement. A Warranty Deed will be issued once the Board of Supervisors approves of the donation.
Department's Next Steps (if approved):
If approved, staff will continue to work with Pioneer Title and a Warranty Deed will be issued to Cochise County.
Impact of NOT Approving/Alternatives:
If not approved, the parcel would remain in the current property owner’s name, and another site for material storage would be necessary.
To BOS Staff: Document Disposition/Follow-Up:
Please return a copy of the recorded documents to H&F, attn: Pam Hudgins.
