Authorize the Procurement Director to negotiate and execute a Professional Services Agreement with JE Fuller Hydrology & Geomorphology, Inc. in the not to exceed amount of $167,620 for Phase I analysis and design services, in accordance with Request for Qualifications No. 10-16-HFP-04 for the initial project development for the Palominas Stormwater Recharge Grant that the Board approved on December 6, 2011.
Background:
On March 23, 2010, the Board of Supervisors approved Request for Qualifications No. 10-16-HFP-04 establishing an on-call qualified list of five engineering firms for Hydrology & Hydraulic Analyses Services. JE Fuller is one of the five firms that were approved. JE Fuller has been selected to provide engineering services for work related to the Walton Family Foundation grant, approved by the Board of Supervisors on December 6, 2011, based on their expertise in hydrology, hydraulics, geomorphology and ability to act as the prime consultant and direct a mulitdisciplinary design team.
The grant period is three years and encompasses site analysis, design, construction and monitoring. The work associated with this grant will be performed in multiple phases. The analysis phase will inform the design phase which will inform the construction plans, etc. Floodplain is currently in the process of negotiating the scope of work and will work with the Procurement Department to negotiate a cost proposal with JE Fuller for the first phase of the project. Time is of the essence to move forward with Phase I, which is the intent of this Board action item. Subsequent phases of the project will be brought back to the Board of Supervisors for approval upon completion of the scope of work and cost proposal for each phase. An approximate scope and cost for Phase I has been included. Between the date required for agenda submittal and the actual Board date, Floodplain and Procurement will continue to work with JE Fuller to refine the scope and cost proposal so that a contact can be approved quickly thereafter.

Department's Next Steps (if approved):
Floodplain will work with Procurement and JE Fuller to negotiate final scope and costs and enter into a professional services agreement for Phase I analysis and preliminary design for the Palominas Recharge/Flood Control Pilot Project.
Impact of NOT Approving/Alternatives:
If the Board does not authorize the Procurement Director to negotiate and execute a Professional Services Agreement with JE Fuller, Floodplain will need to bring the contract back before the Flood Control District Board early in 2012 and valuable time will be lost in the first year of the grant award.
To BOS Staff: Document Disposition/Follow-Up:
An original of the executed agreement between Cochise County and JE Fuller will be delivered to the FCD Board for their records. This phase of the project will not entail any construction or purchase of right of way or property.
