Adopt Resolution 20-20 authorizing the Public Defender, Legal Advocate and Legal Defender Departments to accept court appointment to represent indigent defendants at proceedings authorized by ARS 11-584 and 11-584(10).
Background:
Public Defender Offices are authorized pursuant to ARS 11-584 and 11-584(10) to accept appointments from the superior court to represent indigent defendants in certain proceedings specified in the statute as well as other proceeding or circumstances in which the Board of Supervisors has given approval and notified the presiding judge of the county that the office is authorized to accept those appointments. Over the years the Public Defender has gone to the Board of Supervisors to expand the types of cases that the office can accept. This resolution is to clarify and/or expand authorization by the Board to all three indigent defense offices to accept appointment to all proceedings or circumstances in which a party is entitled to counsel as a matter of law as specified in the statute and to advise the presiding judge of the county of that authorization.
