Adopt Zoning Ordinance 23-02 to approve Docket R-22-04 -Solar Energy Power Plants, an amendment to Section 1824 of the Cochise County Zoning Regulations.

Background:

This is a staff-initiated text amendment to section 1824 of the Zoning Regulations. Article 18 includes development standards for various land uses, Section 1824 specifically applies to solar energy power plants (SEPPs). SEPPs are utility-scale, non-residential solar projects that supply power to off-site consumers. They are considered permitted uses in Industry zoning districts and special uses in Rural and General Business zoning districts. There are several SEPP projects in operation in Cochise County, The changes proposed will update regulations, increase consistency among staff recommendations, and incorporate additional best practices into zoning. Also proposed are measures intended to limit County liability in cases of abandonment, damage, transfer/sale, cessation of use, and the end of the useful life of the SEPP.

On December 14, 2022, the Planning and Zoning Commission unanimously voted (7-0) to recommend approval of this amendment.

Department's Next Steps (if approved):

The Zoning Regulations will be amended as noted, all future solar energy power plants proposals will be subject to these requirements. 

Impact of NOT Approving/Alternatives:

The Zoning Regulations will remain unchanged.
