Adopt Resolution 25-13 to authorize the abandonment of a portion of Huachuca Drive, located in Palominas.
Background:
The Cochise County Engineering and Natural Resources department received a Roadway Abandonment Application from Michael Stoner on December 20, 2023. He has requested to abandon that portion of Huachuca Drive that divides his eight lots. If abandonment is granted, he would then be able to combine all the lots and legally fence the area. Mr. Stoner states that the fence would allow for more room for his family and their pets. It would also help protect them from nearby predators and dogs at loose. The department stated that normally the total length of the roadway is abandoned. Mr. Stoner and the adjacent owners had agreed to abandon the entire length of Huachuca Dr. Unfortunately, the owners to the north are unable to proceed with the abandonment at this time and do not wish to hold up the abandonment request any further. They have agreed that when circumstances are different, they will submit a new Abandonment Application for the remaining northern portion of Huachuca Dr. The Applicant has paid the $300 Administrative Action Fee and the Land Purchase fee of $1,400. The land purchase fee is based on the current land values within the vicinity as set for tax assessment valuations with a 50% deduction based on the area that does not qualify as a buildable lot.
A site review confirmed that the south portion of the road is not open for vehicle travel and there is currently a driveway with some native desert vegetation. If the abandonment is granted, no current parcel would be denied legal access.
There are no objections or concerns from the Community Development Planning Manager.
The current situs address is located on Huachuca Dr and the 911 Rural Addressing MSAG Coordinator has been notified and will issue a new situs address if the abandonment is granted.
APS, Palominas Water & Sewer Co-Op and the Palominas Fire Department do not have objections to the abandonment.

If the abandonment is not approved, the public right-of-way will remain public.
