Adopt Resolution 25-14 to authorize the abandonment of that 30-foot public right-of-way of an unnamed road located near McNeal.
Background:
Cochise County Engineering and Natural Resources received an application from Marshal & Jennifer Bickert requesting to abandon County-owned parcels 404-31-003 and 404-31-006 on October 28, 2024. The applicants own the surrounding parcels and plan to combine all the parcels into one if the abandonment is granted. The parcels were created per a recorded Quit Claim Deed, Docket 428, Page 484, in 1966. The Treasure Land Company deeded the 30-foot-wide, one-mile-in-length strip of land to the Cochise County Board of Supervisors. The deed was recorded before the 1994 Ordinance 013-94, which regulates the creation of public roads, and the 2006 adopted Resolution 06-37 authorizing the need for the acceptance of right-of-way conveyances. The roadway has not been built and is not used for ingress or egress to the property. The applicant has paid their Administrative Fee of $300 and the Land Purchase Fee of $2,550. The land purchase fee is based on the current land values within the vicinity as set for tax assessment valuations with a 50% deduction based on the area that does not qualify as a buildable lot.
If the abandonment is granted, no current parcel would be denied legal access.
There are no objections from the Planning Manager and the 911 Rural Addressing MSAG Coordinator.
There is a Sulphur Springs Valley Electric Co-Op Inc power line that crosses the northern boundary of the proposed abandonment area. SSVEC has acquired an easement from the applicants. The easement agreement with SSVEC will be recorded consecutively with the abandonment deed if approved.
A site review from Lee Road confirmed that the unnamed road is not open for vehicle travel and is currently native desert with vegetation.

If the abandonment is approved, no further Board action is required. Upon recording of the Resolution and Quit Claim Deed and Electrical Right-of-Way Easement, the staff will forward copies/originals to the applicant.

If the abandonment is not approved, the public right-of-way will remain public.
