Order the continued establishment of the Cochise County Jail District pursuant to A.R.S. § 48-4001 and Resolution 25-16 after finding the public interest, convenience, and necessity, subject to voter approval of the excise tax at the election scheduled for November 4, 2025.

Background:

The Cochise County Jail District was initially established in 2022 and funded through voter approval of an excise tax at a May 2023 election. Following litigation and a court-approved settlement, tax collection was suspended, necessitating a new election.

On May 6, 2025, the Board of Directors of the Jail District adopted a resolution calling for an election on November 4, 2025, to submit the excise tax question to voters. The District encompasses all incorporated and unincorporated areas of Cochise County.

This hearing allows members of the public to provide input on the continued establishment of the Jail District. After the hearing, the Board will vote to determine whether the public interest will be served by continuing the District, subject to the outcome of the November election.
