Approve the transfer of a tax deeded property to Cochise County, in care of the Engineering and Natural Resources Department, for use in a right-of-way exchange related to the Davis Road: Central Highway to US 191 road widening project.
 

Background:

The Engineering department is currently in the process of acquiring right-of-way for the Davis Road: Central Highway to US 191 road widening project, Resolution 20-21. Part of this process includes acquiring the right-of-way.
The owners of tax parcel # 404-21-012A desire to exchange the right-of-way acquisition of their parcel for parcel tax parcel #403-54-185, a parcel that is currently being held under a tax deed, (See Exhibits A & B)
Pursuant to A.R.S. § 42-18303, the County may sell parcels deeded to the State for failure to pay taxes. As an exception (E), the County can transfer such a parcel "for a public purpose related to transportation."  Given the County’s potential exchange of this parcel in conjunction with the Davis Road project, this parcel qualifies for a transfer pursuant to subsection E.
The Engineering department is requesting that the tax parcel #403-54-185 be removed from the annual tax auction and be deeded to Cochise County, and placed in the care of the Engineering and Natural Resources Department, to be able to complete the desired exchange.

Execute the deed.
 

Impact of NOT Approving/Alternatives:

The tax parcel will not be eligible for the proposed exchange for ROW and the parcel will not be placed back onto the tax roll.
