Approve the transfer of land held by the State of Arizona under tax deed, as described in Exhibits A & B, to Cochise County and to the Cochise County Flood Control District, for transportation and flood control purposes.
 

Background:

The Engineering and Natural Resources department is currently reviewing flooding along the county-maintained portion of S Taylor Road near Willcox. The department noticed parcels in the State of Arizona ownership near the flooding area. The two tax parcels, #203-11-055Q and #203-11-055W, seem to be possible rights-of-way that were excluded from transfer deeds and then split into unusable parcels or “Q” parcels. These two parcels will be used for transportation purposes. Tax parcel #203-11-055V, located within a flood zone, will be designated for a project aimed at mitigating flooding along South Taylor Road.
Pursuant to A.R.S. § 42-18303, the County may sell parcels deeded to the State for failure to pay taxes. However, pursuant to § 42-18303(E), as an exception, the County can transfer such a parcel "for a public purpose related to transportation or flood control." 
The Engineering and Natural Resources Department is requesting that the two parcels, #203-11-055Q and #203-11-055W, be deeded to Cochise County and parcel #203-11-055V, be deeded to the Cochise County Flood Control District.
