Agenda Item Text:
Approve the appointment of Terry Bannon as Countywide Roving Justice of the Peace Pro Tempore, to serve when no elected Justice of the Peace is available to conduct necessary hearings, pursuant to ARS § 22-121, for the term of April 7, 2026, through June 30, 2027.
Background:
Following the retirement of the Roving Justice of the Peace, the Court initiated a recruitment process to fill the vacancy. A Selection Committee, consisting of seven (7) members, including private attorneys, community representatives, and three judicial officers, was appointed to recommend candidates.
The Roving Justice of the Peace provides coverage for all six Justice Courts. In cases where a judicial conflict results in a full bench recusal, the matter is assigned to the Roving Justice of the Peace, who travels to the respective court to preside over the case. This process allows matters to remain within the County and reduces the need to request an out-of-county judge.
The appointment of a Roving Justice of the Peace Pro Tempore requires approval by the Board of Supervisors.
Department's Next Steps (if approved):
Appointment of the Roving Justice of the Peace Pro Tempore by the Presiding Judge of the Arizona Superior Court in Cochise County.
Impact of NOT Approving/Alternatives:
Where no other elected Justice of the Peace is available or otherwise able to conduct a necessary hearing, there would be no coverage generating delays in court proceedings.
To BOS Staff: Document Disposition/Follow-Up:
