Agenda Item Text:
Approve Intergovernmental Agreement (IGA) to use Pima County's Restoration to Competency Program.
Background:
Several years ago Cochise County began using Pima County's program to restore to competency criminal defendants who were ruled incompetent to stand trial, and accordingly entered into an IGA with Pima County. The cost per defendant/detainee was $20,000. Pima County has requested an increase to $30,000, with a further increase to $39,000 effective January 1, 2017. This IGA reflects those cost increases. There are also several other changes in protocol, including that Pima will not accept defendants/detainees charged only with misdemeanors.
To save costs for restoration to competency, Court Administrator Eric Silverberg has begun employing a psychiatrist to restore competency in the County's jail rather than send them to Pima County. However, the most difficult cases are still sent to Pima County's program. Staff has been actively looking at other alternatives as well, but at this point has not identified any that are feasible.

Department's Next Steps (if approved):
Continue using Pima's RTC program
Impact of NOT Approving/Alternatives:
Cochise County courts would no longer be able to use Pima County's restoration to competency program
To BOS Staff: Document Disposition/Follow-Up:
Have the Chair sign two copies of the IGA, and send both to Roxanne Ziegler at Pima County for signature by Pima's Board Chair.
