Discussion and possible action regarding proposed settlement with Lane Balmer over tax delinquent parcels, judgment lien, and bankruptcy.
Background:
In 2015, in an effort to clean up Fry, we devised a plan to have the Treasurer deed 15 parcels owned by the Balmer family to the State of Arizona for delinquent taxes, which would be followed by auction of the parcels and clean up of the parcels through a joint effort of the County and City of Sierra Vista. In July, 2015, just before the Treasurer was permitted to deed the parcels to the State, Lane Balmer filed bankruptcy, putting the plan on hold.
We have aggressively pursued all legal avenues for relief in the bankruptcy, finally obtaining relief to auction 5 parcels, with relief on additional parcels likely to follow. At that point, Mr. Balmer approached Sierra Vista Assistant City Manager Mary Jacobs about resolving the outstanding issues via a settlement agreement with the City and the County. We are very close to a settlement. A confidential Memorandum from Britt Hanson to the Board concerning the proposed settlement is attached to this agenda item.
