Discussion and possible action regarding proposed settlement with Plaintiffs concerning tax appeal actions challenging Arizona Department of Revenue’s (ADOR) full cash values on three centrally assessed properties; tax appeal case numbers TX2016-000968, TX2017-000534, and TX2017-000511.
Background:
Plaintiffs Red Horse 2 LLC filed two separate appeals to the Arizona Tax Court challenging ADOR’s 2017 and 2018 full cash values for property located in Cochise County. Red Horse III, LLC filed an appeal to the Arizona Tax Court challenging ADOR’s 2018 full cash value for property located in Cochise County. For settlement purposes, these cases are being considered together.
The Arizona Attorney General’s Office is representing Cochise County in these cases and has provided proposed settlement terms for the Board of Supervisor’s consideration. A confidential letter concerning the proposed settlement will be provided for the Board’s review.
Because this agenda item involves the discussion of litigation and possible settlement, the County Attorney’s Office will recommend that the Board go into executive session for this item.
