The County Attorney's Office will provide an update on developments and seek direction from the Board of Supervisors on the following water matters:

1. Approval of County participation in joint press release with The Nature Conservancy and the Bureau of Land Management regarding wet-dry mapping along the San Pedro River.

2. Possible executive session pursuant to A.R.S. section 38-431.03(a)(3) and (7), followed by discussion and direction from the Board regarding the County's role in a potential land transaction in or near Huachuca City, Arizona.

3. Possible executive session pursuant to A.R.S. section 38-431.03(a)(3) and (4), followed by direction from the Board regarding the County's on-going participation as a cooperating agency in the drafting process for the Bureau of Land Management's Resource Management Plan regarding the San Pedro Riparian National Conservation Area.

Background:

1. Approval of County participation in joint press release with The Nature Conservancy and the Bureau of Land Management regarding wet-dry mapping along the San Pedro River.

BACKGROUND: Each year the Nature Conservancy and Bureau of Land Management host an event wherein volunteers walk along the San Pedro River and take measurements of surface flows.  The data collected during this event, which has taken place for nearly two decades now, assists in planning with respect to a variety of conservation projects related to the river, including recharge projects that the County has been implementing.  As indicated in the attached draft release, the joint press release would note the County's support and involvement in the wet dry mapping, as well as highlighting the beneficial uses of the information collected during the event.

2. Possible executive session pursuant to A.R.S. section 38-431.03(a)(3) and (7), followed by direction from the Board regarding the County's role in a potential land transaction in Huachuca City, Arizona.  

BACKGROUND:  A third party will provide a presentation to the Board regarding a land transaction, and potential additional land transactions in the Huachuca City area.  Pursuant to
A.R.S. section 38-431.03(a)(3) and (7), the County Attorney's Office will suggest the Board enter executive session to receive legal advise and discuss possible terms pertaining to the potential real estate transaction.

3. Possible executive session pursuant to A.R.S. section 38-431.03(a)(3) and (4), followed by direction from the Board regarding the County's on-going participation as a cooperating agency in the drafting process for the Bureau of Land Management's Resource Management Plan regarding the San Pedro Riparian National Conservation Area. ("SPRNCA.")

BACKGROUND: The County has submitted comments and engaged representatives of the
Bureau of Land Management in an on-going dialogue regarding the Resource Management Plan ("RMP") the BLM has been preparing regarding the SPRNCA.  As a cooperating agency, the County is required at this time to maintain information regarding the draft RMP confidential.  The County Attorney will therefore suggest the Board enter executive session so the Board can receive an update on the RMP and evaluate and provide direction to the County Attorneys' Office on further work related to the RMP.

Department's Next Steps (if approved):

1. If approved, the County Attorney's Office will work with the County's Press/Information Officer to comment upon and approve the joint press release with The Nature Conservancy and the Bureau of Land Management regarding wet-dry mapping along the San Pedro River.

2. The County Attorney's Office, in conjunction with the County Administrator and his designees, will work with third parties necessary to implement the direction received from the Board regarding the County's role in a potential transaction related to land in Huachuca City, Arizona  

3. The County Attorney's Office, in conjunction with the County Administrator and his designees, will schedule meetings and undertake additional work necessary to implement the direction of the Board regarding the County's on-going participation as a cooperating agency in the drafting process for the Bureau of Land Management's Resource Management Plan regarding the San Pedro Riparian National Conservation Area.

Impact of NOT Approving/Alternatives:

1. If the Board does not approve the County's participation in the joint press release, then the County will not be involved in the joint press release.

2. If the Board does not approve the County's involvement in the potential land transaction, then the County will not obtain the potential benefits of the contemplated transaction

3. If the Board does not direct the County Attorney's Office to continue to participate in comments on the Resource Management Plan, then the County will not submit additional comments or requests for revisions to the Resource Management Plan the the Bureau of Land Management is presently drafting and preparing for public comment.
