Approve request to withdraw/transfer $175,000 from the General Fund Contingency account to fund the County Attorney Office’s Restoration to Competency program.

Background:

For FY20, the Restoration to Competency program was budgeted at $367,000.  Restoration to Competency spending, from FY11 – FY19, has averaged approximately $240,000 per year. The full FY20 annual budgeted amount of $367,000 was expended in the first quarter of FY20. The Restoration to Competency program has received subsidies of $146,000 from the General Government Professional Services line (October 2019 - $95,000; November 2019 - $51,000).  The General Government Professional Services Line is no longer able to subsidize the County Attorney Office’s budget and must be replenished to avoid shortfalls further in the Fiscal Year. Year to date (October 31, 2019) Restoration to Competency expenses total approximately $495,000 for services to 11 patients.

General Fund Contingency account current balance is $17,929,202.


 

Department's Next Steps (if approved):

If approved, funds will be moved from the General Fund Contingency account (100-9900-491.100) to the County Attorney Department budget for Restoration to Competency (100-0600-0610-432.500), and to partially restore funding to the General Government Professional Services line (100-1400-421.000) line which has been subsidizing the program.

Impact of NOT Approving/Alternatives:

Project shortfall in General Government Professional Services line, which funds traumatic counseling, translation expenses, ADP annual expenses, and more. Inability for County Attorney Office to pay invoices to Pima County and the Arizona State Hospital (ASH) for Restoration to Competency services. Cost from unpaid bills from ASH are deducted from State Shared Tax revenues.
