Adopt Resolution 11-57 to call a Special Recall Election for the Palominas Fire District to be held on March 13, 2012.
Background:
On October 20, 2011, petitions to recall Palominas Fire District Governing Board Members Tommy Stoner, Debbie Stoner and Craig Duncan were submitted to the Cochise County Elections/Special Districts Department. After verification of signatures by the Cochise County Recorder on all three recall petitions (see Exhibit A), it has been determined by the Cochise County Elections/Special Districts Department that the petitions against two of the three named governing board members each had over the 267 minimum required signatures and are sufficient for the Cochise County Board of Supervisors to call for a Recall Election to be held on March 13, 2012 pursuant to Arizona Revised Statutes §19-209(A).
One of the two governing board members facing recall, Craig Duncan, chose to resign, pursuant to A.R.S. §19-208, and submitted a written tender to the Cochise County Elections/Special Districts Department. The other board member, Debbie Stoner, chose not to resign, pursuant to A.R.S. §19-208 and submitted a Statement of Defense responding to the grounds of the recall, A.R.S. §19-207. Anyone wishing to have their name placed on the official recall ballot must file a nomination petition with the Cochise County Elections Department. Nomination petitions must be filed between December 14, 2011 and January 13, 2012. The polling location will be the First Assembly of God Church of Palominas, 10466 S. Hwy. 92, Hereford, AZ. Polls will be open from 6:00 am until 7:00 pm on March 13, 2012. The last day to register to vote in the Palominas Fire District Special Recall Election is February 13, 2012 and Early Voting begins on February 16, 2012. The Palominas Fire District will reimburse Cochise County for all election costs.

The Elections/Special Districts Department will contact Elections Operations Services (EOS) and instruct them to proceed with programming the ballots for the Special Recall Election for Palominas Fire District.
