Discussion and possible direction on litigation options regarding Welch v. Cochise County Board of Supervisors.

Pursuant to A.R.S. § 38-431.03(A)(3) and (4), the Board may go into executive session for legal advice with the attorney of the public body and to consider its position and instruct its attorneys regarding the public body's position in pending litigation.

Background:

Judge Monica Stauffer dismissed the case Welch v. County Board of Supervisors.  The Court of Appeals has now reversed key rulings made by Judge Stauffer.  The purpose of this agenda item is to discuss the Court of Appeals opinion and possible ramifications and options in the litigation.

Pursuant to A.R.S. 38-431.03(A)(3) and (4), the Board may vote to go into executive session to seek legal advice from their attorneys and discuss pending litigation.
