Discussion and Possible Direction concerning Proposition 207, the Smart and Safe Arizona Act, allows counties to enact reasonable zoning regulations of recreational marijuana uses.
Background:
The Cochise County Zoning Regulations specifically allow medical marijuana cultivation and dispensaries due to the Proposition 203, Arizona Medical Marijuana Act, approved by voters in 2010. Proposition 207, approved by voters in 2020, legalized and regulated the production, sale, possession, and consumption of recreational marijuana.
Department's Next Steps (if approved):
Direction from the Board of Supervisors before presenting proposed Zoning Regulation changes to the Planning & Zoning Commission that allow for recreational marijuana dispensaries and cultivation.
