Discussion and possible direction regarding the ongoing litigation and potential settlement regarding Welch v. County Board of Supervisors, CV201900060.
Pursuant to A.R.S. § 38-431.03 (A)(3) and (4), the Board may go into executive session for legal advice with the attorney of the public body and to consider its position and instruct attorneys regarding the public body’s position in pending litigation.

Background:
On September 2, 2021, the Arizona Supreme Court issued its Opinion in the Welch lawsuit and remanded the case back to the Judge Monica Stauffer (trial court) for further proceedings. On January 12, 2022, Judge Stauffer issued a scheduling order setting out the deadlines for discovery, witnesses, and dispositive motions, as well as the trial date. At this time, Jim Jellison, of Jellison Law Offices, would like to discuss the lawsuit, current procedural posture, and legal strategy with the Board, as well as solicit guidance and direction from the Board regarding potential settlement.
