Approve an application for a permanent Extension of Premises liquor license submitted by Mr. Stephen Woolf for Mescal Bar & Grill located at 70 N. Cherokee Road in Benson.
Background:
Mr. Stephen Woolf has applied for a Permanent Extension of Premises/Patio liquor license for Mescal Bar & Grill located at 70 N Cherokee Road in Benson. The extension of premises/patio is permanent and will extend to cover the new smoking area in order to comply with newly approved State smoking laws.
The Planning & Zoning Department has recommended approval. The Sheriff's Office opted to not make a recommendation due to several incidents at the Mescal Bar (please see attached memo).
The Board has three options available to it, on any liquor license application: Approve, Disapprove or make a "No Recommendation" to the ADLLC. If the Board makes any recommendation other than "Approve", the ADLLC will hold a hearing on the matter.
It should be noted that the applicant has not been convicted of a felony charge in the past five years, and that is the hard and fast test for a Board recommendation of "Disapproval". It should also be noted that this Board has approved Extension of Premises applications for several successive years, based on a recommendation of Approval from the Sheriff's Office, with no additional information provided in the past (see attached copies of Sheriff's past recommendations). However, in light of the Sheriff's position on this year's application, the Clerk of the Board is recommending that the Board take a "no recommendation" action on this application. The Clerk has met with the applicant to explain the Board's options, what her recommendation is and why; she also provided a copy of the Sheriff's memo to the applicant. Supporting documentation regarding this liquor license is on file with the Clerk of the Board of Supervisors.
