Adopt Zoning Ordinance 23-01 to approve Docket R-22-03 - Wind Energy Power Plants, an amendment to Section 1822 of the Cochise County Zoning Regulations.

Background:

This is a staff-initiated text amendment to section 1822 of the Zoning Regulations. Article 18 includes development standards for various land uses, Section 1822 specifically applies to wind energy power plants (WEPPs). WEPPs are large, non-residential, turbines that supply power to off-site consumers. They are considered special uses in Rural, General Business, and Industry zoning districts. There is currently one WEPP project in Cochise County, The changes proposed will update and incorporate additional best practices into zoning. Also proposed are supplemental safety provisions and measures intended to limit County liability in cases of abandonment, damage, transfer/sale, cessation of use, and the end of the useful life of the WEPP.
On December 14, 2022, the Planning and Zoning Commission voted 7-0 to recommend approval of this amendment. 

Department's Next Steps (if approved):

The Zoning Regulations will be amended, all future wind energy power plants will be subject to these requirements. 

Impact of NOT Approving/Alternatives:

The Regulations will remain unchanged.
