Modify current standing action by the board of Oct. 24, 2022, regarding hand count audit Pursuant to ARS 16-602 B; to be 99.9% of ballots will be counted. (TO BE DECIDED IN EMERGENCY/SPECIAL MEETING-requested by 11/15/2022)**

Background:

Over 200 volunteers have been legally provided by County Party Chairs and are prepared to participate in a hand count of all ballots in our County for the, now past, General Election. They are wishing to take part in this way to help people (including a few of the participants) who have lost trust in elections to see that elections are reliable and secure in our county. Two other results of this hand count will be simply a larger random selection audit of machine accuracy and a test of our back-up plan in case some or all of our machines become compromised or fail at last minute. The Arizona Revised Statutes have never prohibited hand count, even when adding provisions for using the machines for counting. County Recorder David Stevens, our State Senator and Representatives are in support of this and will be able to follow through with proper action in the Legislature as needed. As a result of the politically derived ruling recieved Nov. 7, 2022, on the eve of the General Election Day a restrictive and damaging precident will be set.  Our handcount should proceed legally according to limitations set within that document to provide a positive path forward for Cochise County and other who desire more transparent elections.

Department's Next Steps (if approved):

Allow Recorder Stevens to hold the hand count audit as soon as possible to have results prior to Canvas of Election. ** AS 99.9% HAND COUNT WILL NOT BE COMPLETED FOR DAYS AFTER THEY BEGIN.  THIS ITEM COULD BE APPROVED AFTER THE HANDCOUNT COMMENCES WITH A RANDOMLY SELECTED PORTION OF BALLOTS.
