[Item tabled from the October 10, 2023 Flood Control District Meeting] Adopt Flood Control District Ordinance FCD 052-23 approving the revisions to the Floodplain Regulations.
Background:
The Floodplain Regulations were updated in December 2015. The current regulations are not in compliance with Arizona Department of Water Resources and Federal Emergency Management requirements and in some cases vague for property owners and developers. This draft reflects needed state and federal changes to be in compliance with the National Flood Insurance Program (NFIP). The Floodplain Regulations were initially adopted in 1984 and revised several times since then.
These revisions include clarification from the public comments we have received sine the first public hearing presentation to the Board on July 25, 2023.
Updates include: clarification of the requirement to have all habitable structures be elevated to provide positive drainage; updated definitions; updated non-residential construction to clarify agriculture structures

Department's Next Steps (if approved):
If approved, staff will administer development with the new floodplain regulations.
Impact of NOT Approving/Alternatives:
County would not be in compliance with ADWR and FEMA NFIP regulations. The County could face suspension from the NFIP and/or loss of our Community Rating System (CRS) rating, which provides citizens of Cochise County a 5% discount on flood insurance.
