Discuss potential or future litigation involving the County and the Board of Supervisors, evaluate any potential conflict of interest involving the County Attorney’s Office, and consider the retention of outside counsel to provide legal advice in cases where a conflict of interest or disharmony with the County Attorney’s Office may exist.

Pursuant to A.R.S. § 38-421.03 (A)(3) and (4), the board may go into executive session for legal advice with the attorney of the public body to consider its position and instruct attorneys regarding the public body's position in pending litigation. 

Background:

The Board of Supervisors relies on the County Attorney for legal counsel on various matters, including statutory obligations, litigation, and governance. The scope of representation provided by the County Attorney is essential in ensuring that the Board receives appropriate legal advice to make informed decisions.

Given the complexities of ongoing and potential legal matters involving the County, the Board seeks to clarify and discuss the extent of the County Attorney’s representation, including any limitations, conflicts of interest, or areas requiring additional legal support.

This discussion will help determine the appropriate course of action to ensure that the Board's legal needs are adequately met. Pursuant to A.R.S. § 38-421.03 (A)(3) and (4), the Board may enter executive session to receive legal advice and provide direction to its attorneys regarding the County’s position on pending litigation and related legal matters.
