Approve the award of Request for Qualifications (RFQ) No. 11-02-CAO-01 to adopt a qualified list of nineteen (19) Attorneys to provide Indigent Defense Services.

Background:

Currently, any attorney who wishes to receive court appointed cases must submit to IDC a letter of interest, resume and current liability insurance certificate. IDC confirms that the attorney is an active member in good standing of the Arizona State Bar Association, ensures that the attorney meets minimum qualifications established by IDC, and advises the Presiding Judge of the attorney's application. In order to standardize the process and develop a fee schedule for Indigent Defense Contract Attorneys, a contract including a fee schedule was developed in concert with a Request for Qualifications solicitation to create a qualified list of Attorneys to provide Indigent Defense Services.

Solicitation notices were mailed to fifty-nine (59) firms. The solicitation was posted on the County website and advertised in the Arizona Range News from March 7-14, 2012. The solicitation was also posted on the Arizona Attorney Career Center website for 30 days beginning March 29, 2012. A pre-submittal meeting was held on March 15, 2012 at 10:00 a.m. Seven (7) Attorneys were present at the meeting. Twenty-one statements of qualifications were received prior to the RFQ closing date of April 25, 2012 at 4:00 p.m.

An evaluation panel consisting of representatives from the Indigent Defense Department, Procurement Department and a Consultant evaluated, scored, and ranked the statements of qualifications received. As a result of the evaluation process nineteen Attorneys are being recommended for the qualified list to represent various classes of cases for Indigent defense Services for Cochise County. The list of qualified Attorneys is attached.

The list will be valid for one (1) year with an option to extend on a year to year basis at the County’s discretion for a maximum of four additional one-year periods.

Based on the prior year’s case assignments and expenses, IDC anticipates projected overall cost savings of approximately $22,329. (Misdemeanor and probation revocation costs would increase by approximately $76,562 and delinquency and dependency costs would decrease by approximately $98,891.)
