Agenda Item Text:
Adopt Resolution 25-16 calling for a public hearing to consider the continued establishment of the Cochise County Jail District, to be held on August 5, 2025, at 10:00 am in the Board of Supervisors Hearing Room, 1415 Melody Lane in Bisbee, Arizona.
Background:
On October 21, 2022, the Board of Supervisors of Cochise County (“Board”), pursuant to A.R.S. § 48-4001(A), approved Resolution 22-28, stating its intent to consider the establishment of the Cochise County Jail District. Then, on November 15, 2022, a hearing was held on Resolution 22-28, pursuant to A.R.S. § 48-4001(B), for the Board to hear persons in favor of and against the establishment of the Jail District. After that public hearing, the Board of Supervisors adopted Resolution 22-29, finding that the public interest, convenience, and necessity will be served by the formation of a Jail District. Following the subsequent excise tax election, litigation, and ultimate settlement, the Board of Directors has called for an election on November 4, 2025, to consider the excise tax again. Therefore, it is in the best interests of the county to ensure the public has an opportunity to speak about the continued establishment of the Jail District, as before, and hear arguments for and against. This resolution announces such a public hearing will be held on August 5, 2025.
Department's Next Steps (if approved):
Publish public notices announcing the public hearing in local newspapers as directed by statute.
Impact of NOT Approving/Alternatives:
Lack of a public hearing could have legal consequences.
